

On May 11th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Donnie Hudleston at 6:00 pm.
Present: Donnie Hudleston (Troon), Billy Christopher (Canebrake), Chris Piette (Piney Creek E), Frank Stauch (Piney Creek W), Jessica Hall-Jones (Colony), Robert Black (Winged Foot), Rex Dove (Riviera), Beverly Van Wagner (Hughes Property) and Jimmy Smith (Founders).
Not Attending: Jim Kjer (Long Cove).
The first order of business this month was the discussion of violations, homes in foreclosure and fines. The HOAB main issue with foreclosures is that a majority of these homes will not be maintained and the lot will become an eyesore for the neighborhood. Homeowners that live next to these type dwellings have taken on the task of lawn maintenance to improve the appearance of their neighborhood. Although this is greatly appreciated, residents who cut and or maintain this property are advised you may be liable for any damage that may be done to the property in the performance of this upkeep.
The HOAB is considering a change to the covenants allowing the HOA the right to access to the property in order to maintain the lawn in the event of foreclosure or other situation where the homeowner is not keeping up with the maintenance of their lot or lawn. The challenge is finding out who owns the property, in order for the HOAB to request authorization to perform this maintenance, charging the responsible owner / financial institution. If the change is approved however, this is a time consuming endeavor and will be undertaken only as necessary. Holding financial institutions responsible can be more difficult if the lot is being maintained by another home owner.
During last month’s meeting we held a brief discussion on employing a security guard for the community and utilization of the guard shack at the front entrance of Canebrake. After much debate it has been determined that a small committee consisting of an HOAB rep and an owner is being formed to gather information on pros and cons, presenting options to the HOAB / Owners for consideration. It is anticipated the initial hours for this guard will between 11pm to 7am seven days a week. Among the many concerns are funding, HOA rates increasing, city approval, and Canebrake homeowners even wanting this. In addition the HOAB is looking at sponsoring a community watch program. This committee will need take a few month’s to completely address all the concerns and scenarios’ posed by this group.
The sidewalk construction was again a topic of discussion at the meeting because no definite date for work to begin had been established. The City of Athens has stated they will begin work on this project once they are finished at the new Fire Station, within 3 to 4 weeks.
The last topic for discussion was the playground area that is located by the tennis courts; the HOA is going to work with a volunteer graphic designer, donating his skills to help plan/design an area for the community to use as an activity center.

The first order of business this month was the ongoing speeding issues throughout the Canebrake community, the radar machine that had been setup by the Athens Police Department has been taken down due to vandalism. The radar machine had its tires slashed; the police department had to repair the unit before they could take it away. If anyone has any info on this, please city a HOAB member or contact the City of Athens directly. On a positive note, several tickets have been issues within the Canebrake community; some of the speeding tickets issued have been in excess of 50Mph. The patrols in the neighborhood will continue, lets all try to watch our speed.
The second order of business pertained to the sidewalk construction activity; at the meeting no definite date for work to begin had been established. The main reason for the project delay was the uncertainty of rainy conditions normally associated with the month of April. The HOA would like to limit the mess that will come along with this type of project, so the HOA and City are looking for a start date no later than June.
Last month the issue of excessive littering had been addressed, just a short update related to that and that is the golf course grounds crew does a weekly and weekend patrol of the neighborhood for trash pickup starting around 0630 and on most days they will conduct at a minimum of 2 patrols. They pick up debris throughout the community, although if you are out and about and run into trash dumped on the side of the road please stop and help out the community to keep the neighborhood clean.
The last topic for discussion was the playground area that is located by the tennis courts; many suggestions to make improvements to that area are being discussed, like new playground equipment to even a possible pavilion area near the playground for BBQ and social events. The HOA feels like this will be a great addition to the community and this could really benefit everyone, but like everything else this will come with a cost. New quality playground equipment is not very cheap and it would take a few years of purchasing a piece or two every year. The HOA is requesting that someone in the community donate some time and skills to help plan/design an area for the community to use as an activity center. This project could be accomplished over a period of time and would really benefit all.
The closing statements brought on a brief discussion on employing a guard for the community and utilize the guard shack at the front entrance of Canebrake. There was also a brief discussion on possibly organizing a Community Watch Program; these topics of discussion will be brought up again in the May HOAB meeting.

The first order of business conducted by the HOAB this month was a discussion about disruptive Pets in the community. Several homeowners have brought this on-going problem to the attention of the HOAB, constant dog barking. A letter will be going out soon to advise Canebrake Community residents on how to properly handle this issue. This issue is also addressed in the Canebrake Covenants and there is also an Athens City Ordnance directed towards disruptive pets. Beverly Van Wagner from Hughes Property will be sending a mass mailing to Canebrake homeowners related to pets in the community, this also addresses pet waste and walking of pets in the community. The HOA works to ensure the safety of the residents and wants the residents to know that their complaints are acted on accordingly.
The second order of business was how to handle residents that pay their HOA dues on a quarterly basis. Although it is preferred that the HOA dues be paid in full, the covenants allow residents to pay quarterly. Beverly Van Wagner will be putting out more info related to this issue, as it is not fully understood by most that are paying quarterly, there may also be an increase to those that pay quarterly as it requires more resources to process those payments.
The sidewalk project will be expanded to include Riviera to Piney Creek. Coordination with the City of Athens is still being conducted and weather is going dictate the start of the project.
The HOA has asked for more patrols to be conducted in the Canebrake Community to cut down on the excessive speeding in the neighborhood, it is the HOA’s intent to reduce this by having the City of Athens Police department issue tickets throughout the community. We will continue to have the patrols setup in the community on a regular basis.
One last issue is the noticeable increase in littering throughout the community, several complaints have been noted and some of the HOA members have noticed the increase as well. Construction crews are going to be approached and asked to maintain their lot, also if you see trash in the community you are encouraged to help pick it up. The HOA is going to look into having the maintenance crew patrol the neighborhood on the weekends to help pick up trash.

A request will go out to our City Councilman, Harold Wales, to get the Athens police to begin their patrols throughout the Canebrake Community looking for speeders and issuing tickets. Beverly Van Wagner from Hughes Property will be sending a mass email to Canebrake homeowners about the dangers of speeding and warn them that patrols will be increased throughout the Community. The HOA wants to ensure the safety of the residents and wants the residents to know that their complaints are being acted upon.
The second order of business also pertains to the safety of our residents throughout the community and that is the authorization to utilize HOA funds for putting in a sidewalk. This is to be a 2 (two) phase plan, first phase will be from Crooked Stick to Troon and then the second phase will be from Troon to Riviera. Canebrake HOA has approved funding for both phases; paying for the materials and the City of Athens has agreed to supply the equipment and labor. This project will greatly add to the Community and provide the Colony a safe passage way and much needed access to the common grounds especially the pool. If everything goes well, work will begin within a few months. Much coordination and preparation needs to be conducted up front and of course the weather will also be contributing factor that will dictate the start of the project.
Many other projects that were brought up during the Annual HOA meeting are being considered as projects to invest in for the overall Community. Many options were laid on the table such as: new playground equipment, more landscaping in and around the Canebrake entryway, improving the Christmas décor and a walking trail. The main 2 (two) topics discussed were the new playground equipment and the additional landscaping; both of these projects will receive much more attention in upcoming meetings. But with the expenditure of funds to get the sidewalk project started, it was determined that the other projects will have to wait until later in the year, as it would not be beneficial to spend all the surplus funds at one time.

With this being the first HOA meeting of the New Year, the HOA would like to wish all residents a happy and prosperous year. Last month’s HOA meeting primarily dealt with Canebrake resident issues that are of a personal nature and minutes are not submitted for those type issues. Also as a reminder to the residents of Canebrake, this is an election year for 5 members, with the possibility of adding an additional member for the new construction areas.

The second order of business was the discussion of the Canebrake Golf Course fairway boundary lines. Many boundary stakes/lines are not clearly marked anymore and golfers have been hitting balls from within resident’s property lines. The consensus was to ask the Canebrake Golf Course Superintendent to put more boundary stakes up on areas that are having the most problems, and to review specified areas if further complaints are made by homeowners.
The Canebrake Club LLC Homeowners Association 2009 annual report was reviewed by those present and ideas were gathered for ways to improve the neighborhood with the surplus of positive cash flow. All were asked to discuss with other homeowners to seek insights and gather ideas for improvement projects that Canebrake homeowners may need or want. Many options were laid on the table such as: playground equipment, more landscaping, improving the Christmas décor and a walking trail.
Billy Christopher explained that the Canebrake entryway has a problem with the electrical source for Christmas décor and consistently requires a large sum of money to be spent each year. Billy had already researched the problem and had a long term solution to present to the board. A motion was made by Jimmy Smith and seconded by Jessica Hall-Jones to authorize Billy Christopher to spend up to $2,000.00 to come up with a final solution for the electrical problem with the entrance way.

First order of business conducted by the HOAB this month was receiving a request for reduction of fines currently assessed to a homeowner. The results will be forwarded directly to the property owner. Once discussions were completed on this request, follow on Board discussion revolved around our policy that ALL requests to appeal violations must be presented to the HOAB in person by the property owner or his/her legal proxy. Determinations on each presented case will be decided on a case by case basis and no determinations will be published as these are private matters.
It’s that time of year again for the Holiday season when many family traditions and religious beliefs play a part in the community Holiday celebrations. Holiday Decorations will begin coming out and this year we will continue to go by the guidelines established last year. The Holiday Decorations covenants will be relaxed and will be allowed for a length of time from 1 Nov to Jan 15. Unless a dwelling is deemed a nuisance the covenants will go un-monitored.
The Annual Home Owner Association meeting will be held on the 17th of November, this is the time for all home owners to take part in to hear how the HOA is taking care of business in your community. You can also meet your street representative if you already haven’t and voice your concerns within the Canebrake community.

First order of business conducted was to do a meet and greet with the newly elected street captains. A suggested HOA Mission Statement provided by the outgoing President, Bruce Cole, was reviewed and very well received, along with informing the new street captains… Frank Stauch, Piney Creek W, Rex Dove, Riviera, and Jessica Hall-Jones, Colony… of their roles and responsibilities as HOA members. There will be more to follow on the HOA Mission Statement, as the new HOA President Donnie Hudleston champions it to its end state and has it placed on the web.
Elections of new positions on the board where conducted and Jessica Hall-Jones has been elected as the Vice President and Chris Piette volunteered to act as the Secretary again…thanks! Just as a reminder, elections of new board members will be held each July. Nominations are received and ballots go out by the end of the July. New members will be notified in August and assume active positions in September.
The new board members were also made aware of what the role of Hughes Properties is within the Canebrake Community. Fines and Violations were briefly discussed with no major issues brought to the table. There is one resident that wishes to plead their case to the HOA next month.
The Canebrake Community Yard Sale has been brought back to the table for discussion. After much debate a vote was held to allow or to abandon the community yard sale. By a unanimous vote the community yard sale is a no go. Although the board did state that if someone or a community group felt strongly about this cause, than it can be presented again by an individual or individuals who would be willing to take responsibility to organize and coordinate the community yard sale.
The HOA Budget was discussed again to primarily make the new members aware of the work that has been done to put the budget back on track and to reiterate the HOA’s positive cash flow. It was explained that there were too many uncertainties that new partners had to deal with and too much history to go through from the previous owners. So, after wading through the mountains of records from the last Canebrake Owners it was determined to start with a new approach and begin gathering data for better record keeping. With that, if next year provides the same rate of success as this year and it turns out that the HOA budget can maintain a positive cash flow, it would be very possible for a surplus of cash to become available for community improvements that have been requested over the years.

Not attending were Jimmy Smith, Jim Kjer and Marcy McDonald.
There was no HOAB Meeting held for the month of July, many members could not attend during that month. Just a couple items to report from this month’s agenda, first order of business conducted were a brief discussion on Fines and Violations. Actions are pending.
Individuals nominated for positions to the HOAB for Riviera (Marcy McDonald), Piney Creek West (Bruce Cole) and the Colony (Jessica Hall-Jones) have been received and the following individuals will be on the August Election Ballot:
Nominations from the Colony were not accepted; therefore Jessica Hall-Jones has volunteered to serve another term as the representative for the Colony.
Terry Hickerson and Frank Stauch have been nominated for Piney Creek West.
Rex Dove has been nominated for Riviera.
August 14 the election ballots are to be mailed. August 26 the election ballots will be returned and the individuals that have won will be notified. Results will be posted in August HOAB Meeting Minutes and new members will assume active positions in September.
This year the HOA has managed to pay back a loan provided to them from Canebrake. Also, the HOA will operate in the black for the first time in years. This is attributed to past dues being collected and HOA dues being paid on time. Not to mention with a little help from fines being collected that have contributed to having a positive impact on the HOA budget. If this trend were to continue with the same rate of success, it is very possible for the HOA budget to maintain a positive cash flow and operate in the black again next year. A complete breakdown of the budget is to be provided to the HOA in future meetings.
The HOAB will be asking the Athens Police for more continued patrols throughout the community to address the speeding in the community.

On June 18th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:00 pm. Those present included Bruce Cole, Chris Piette, Jimmy Smith, Billy Christopher, Marcy McDonald, Jim Kjer and Beverly Van Wagner. Not attending were Robert Black, Jessica Hall-Jones, and Donnie Huddleston.
Only a few items to report on this month’s agenda, first order of business was a short discussion on Fines and Violations. Actions are pending.
The possibility of holding a Community Yard Sale was brought to the table for consideration; a motion to hold an internal vote was made. The HOAB voted to have this Yard sale but only if the majority of the Community Residents approved of this idea as well. The plan is to hold a Community Yard Sale once a year around the 1st week in October. Each homeowner can elect to participate by using their residence. The HOAB considered possibly providing Port- A-Potties for this event to be placed throughout the Community. Please contact your street captain with your input and your thoughts on this community event.
In July the HOAB elections will begin and ballots will go out this month for nominations to the HOAB. The street positions that are to be vacated are Riveria (Marcy McDonald), Piney Creek West (Bruce Cole) and the Colony (Jessica Hall-Jones). Election results will be posted in August and new members will assume active positions in September.
It has been brought to the HOBA attention of a potential problem with people fishing in the golf course ponds. Please respect the ponds and the surrounding areas, clean up after yourself and be mindful of the golfers that are on the course. There have been designated fishing areas in the past with little to no enforcement. All of the ponds can be fished on Tuesday’s, but not all areas of the community are accessible by vehicle; don’t use the maintenance roads as access to the fishing ponds. Utilize golf carts or walk- to areas if necessary. Let’s not let this get out of control and have this luxury taken away by the select few that choose to do it their way.
One last note, the HOAB has asked Athens Police for continued patrols throughout the community to address the speeding in the community.

On May28th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:00 pm. Those present included Bruce Cole, Chris Piette, Robert Black, Jimmy Smith, Jessica Hall-Jones, Billy Christopher, Marcy McDonald and Jim Kjer. Not attending were Donnie Huddleston and Beverly Van Wagner.
The first item on the agenda for this month’s meeting was on Fines and Violations, in the past to date liens have been imposed on properties for late Association Dues and not for fines. Each November, Hughes Property will research properties to find the rightful owner on file at the city tax collector. If you have had fines placed on your property for unresolved or unattended issues, titles have been researched and the owner on record will have a Lien placed on that property. Hughes Properties will bring before the HOAB subject properties to have Liens placed upon them for violations and failure to pay or comply. Each Lien can be rebutted in a formal meeting with the HOAB and the appeals will be heard and judged.
All residents please be aware and be respectful to your neighbors, we are getting reports of people cutting through private property to get to the pool and tennis courts. We understand that with summer more activities are going on, but this does not preclude you from using the public entry points for these areas in the community. Please reframe from doing this and utilize the common areas and public access routes to gain access to these areas.
Well, it is that time of year again that we spend the weekend mowing grass and trimming the landscaping, by the way the community is looking great! DO NOT use the Canebrake common areas for dumping grounds of your private properties lawn trimmings. Take the extra time to bag your refuse and place it next to your garbage can for pick up. Canebrake cannot and will not dispose of this waste.
The Stop Speeding Campaign that was kicked off last month has had an impact throughout the Canebrake Community. Although we feel as if we could fully finish what we originally intended and that is to monitor the entire community and not just the main entrance/exit of Canebrake. With this in mind we are asking for continued patrols and speed monitoring measures be placed in various locations to aid in limiting the speeding problem. With more people out and about with the nice weather that we are having, we want to have a safe summer for our residents.

On April 26th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by Vice President, Donnie Hudleston at 6:00 pm. Those present included Jim Kjer; Jessica Hall-Jones; Jimmy Smith; Beverly Van Wagner; Chris Piette; and Billy Christopher, Canebrake Club, LLC Manager. Those not in attendance were Bruce Cole, Robert Black, and Marcy McDonald.
Canebrake HOAB stop speeding campaign has been a very interesting project. Most of the community has been very supportive and yet there are a few that are totally against this. To date of this meeting 6 tickets have been issued and the radar data collector has been fixed.
Since the Radar has been fixed it will be placed in key locations within the Canebrake community throughout the remainder of April and into May. These sign will be placed for inbound and outbound traffic on Canebrake Lane. Other streets to be monitored will be Muirfield and both ends of the Piney Creek extension will be monitored as well. Athens Police will still be holding patrols throughout the community.
Fence maintenance and fence standards are still in discussion, it is very difficult to decide on the specific standards to be placed on wooden fences throughout the Canebrake community. It has been recommended that the Arc take this as a task to determine the best resolve and set the standards for fence maintenance.
The last item of discussion was about instituting late fees for HOA dues. Payments have been applied at four (4) payments at $90.00 a quarter or a single payment $360.00 per year in the first quarter of every year. It seems that about 75% to 80% of the Canebrake HOA members pay in full once a year. The remaining chooses to pay by the quarter and pay on time, but there are still a few that remain unpaid and continue to run late.
Effective June 1st the bylaws for the HOA will be amended to institute late fees on HOA dues. A $25.00 per month late charge will be placed on delinquent accounts every month until the amount due is paid. Also, if the HOA member chooses not to pay a lien can and will be placed against a home for the amount due plus late fees.

On February 26th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:00 pm. It was much appreciated that our City Councilman Mr. Harold Wales took time to spend the evening with us discussing our problems with speeding in the community. Canebrake HOAB is planning a full scale stop speeding campaign to improve the safety and wellbeing of the residents within our community. We asked for the support of our city leadership to aid in this campaign and we have received very positive feedback and great support
There will be Radar signs placed in key locations within the Canebrake community throughout the month of April. These signs will placed for inbound/outbound traffic and will display the speed of the vehicles. Not only will Canebrake Lane be monitored but Muirfield and both ends of the Piney Creek extension will be monitored as well. The signs are to assist in educating each driver of their speed. Increased patrols will also be noticed throughout the community.
Along with the issue of speeding we have also asked our City Councilman for support to possibly get sidewalks installed from Riviera to the Colony area. Mr. Wales has discussed these with other City Councilman and the Mayor.
The next HOA meeting is scheduled for the 23th of April at 6:00 pm. The topics for next month’s agenda are Speeding and Side Walks. Any additional agenda items need to be submitted to Bruce Cole before March 15th.
On February 26th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:00 pm.. The first order of business was to discuss covenants violations. Violation letters have gone out over the past few months which have made an impact in the neighborhood and many of the violations seem to be under control. No fines are being sent out this month. Although during the patrol of the community it became apparent that there are no standards for fence maintenance. The covenants have been reviewed but there are no clear guidelines for proper fence maintenance. This issue going TO the ARC for further review…more to follow on this.
There have been many discussions over the issue of speeding within the Canebrake community. This has been a hot topic for many residents and we are going to seek help from our city councilman. Mr. Harold Wales has accepted an invitation to the next HOAB meeting. Along with the issue of speeding we will also be asking for support to possibly get sidewalks installed from Riveria to the Colony area.
Many comments and complaints have been noted in regards to the street lights not operating properly. These issues can be resolved by making a call to The City of Athens Street Department. Their number is (256) 233-8747. It may be necessary to call more than once if no action has been taken within a week or so.
The HOA Budget was also discussed in length and the HOA is looking into several avenues to balancing the budget. It was determined that the best path forward to balancing the budget would be to evaluate the current costs against the budget data collected over the past years. By doing this we can provide a more realistic budget for the future.
One last note, the Hughes Property Contract will expire at the end of April. Negotiations are being conducted to renew this contract.

On January 22th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:30 pm. Those present included Bruce Cole; Marcy McDonald; Jim Kjer; Jimmy Smith; Donald Hudleston; Jessica Hall-Jones; Robert Black; Patricia Fulmer Chris Piette; and Billy Christopher, Canebrake Club, LLC Manager.
The first order of business for the New Year was to address the covenants violation of parking on the street issue that has been ongoing. Several violation letters have gone out over the past few months which have had good results and the situation currently seems under control. However, one final notice has gone out to a repeat offender which has resulted in fines being imposed.
Again, the biggest discussions on the table during this meeting were the Hughes Property Violation citations. The HOA has hired Hughes Properties to enforce the covenants for the Canebrake Community. It is their responsibility to ensure that Canebrake residents comply with the covenants, and violations will be dealt with. Some members of the community feel as if violations are being missed and/or overlooked. Declaration of Covenants Article V 1 (a), (b), (c), (d), (f), (p), (q), (t) and (w) violations seem to be the biggest complaints. If anyone in the Canebrake community believes that violations are not being addressed or enforced, feel free to contact your Street Captain and/or Patricia Fulmer from Hughes Property.
As a reminder, ALL holiday decorations were required to be taken down by January 19th. Take notice to comply with the Holiday decoration schedule.
Another interesting point of discussion was the Port-a-Potty located on Winged Foot Lane between holes 4 and 5. A motion was made to have this relocated out of site from the road as it has been deemed an eyesore by the residents on this street. More will follow on this motion as it gets resolved.
One last note, the invoices for Annual Home Owners Association dues have been sent. Please make plans to have your payments in during this first quarter of the year. A reminder will go out by the second quarter for those who haven’t paid. So let’s get those dues in early and avoid the cost of sending more invoices.

On September 15th the Home Owners Advisory Board (HOAB) met. The meeting was called to order by President, Bruce Cole at 6:30 pm. The first order of business was to elect the HOAB Vice President and Secretary. Donald Hudleston and Chris Piette were elected respectively. The Vice President will become the New President upon the end of term of the current President Bruce Cole.
The HOAB members serve for 2 year terms and next September will be the end of term for members Bruce Cole (Piney Creek West), Marcy McDonald (Riviera) and Jessica Jones (Colony). With that in mind, it has been determined that Election Ballots will be sent out on or about July 15th 2009. If anyone is interested in becoming an HOAB Representative this will be your chance to get involved.
A general reminder for the Canebrake Community… the Home Owners Association (HOA) will be meeting September 23 at 6:00. Please take the time to attend this annual event; there will be many interesting topics on the agenda. You’ll be able to meet your street Captains, who will be your voice to the HOA.
The next HOAB meeting will be on October 21 at 6:30pm. All agenda items need to be submitted to Bruce Cole before the 16th. All subsequent HOAB meeting will be on the 3rd Thursday of every month.

On July 29, a meeting of The Homeowners Advisory Board to the Declarents was held. Bruce Cole, the President of The Homeowners Advisory Board and representatives Jessica Jones and Marcie McDonald met with Billy Christopher, Canebrake Club, LLC Manager. Betty Hughes and Patricia Fulmer of Hughes Property were also in attendance.
Other officers are to be determined at the next meeting on August 19, when the new street representatives attend their initial meeting. Also, at the next HOA Advisory Board meeting, a late September date will be finalized for the Annual Homeowners Meeting.
